3. For what purpose do we process data on these websites and on what legal basis? Who is the recipient of the data?
We collect and use personal data to provide the websites and our content and services in accordance with the provisions of Art. 6 para. 1 a to f GDPR, i.e., insofar as the GDPR or another legal provision permits this, or the user has consented to the processing. Personal data may be disclosed to the following recipients to fulfill the purposes listed in this section: Where necessary, authorities, courts or other public bodies in Germany and abroad. Other IT service providers and other processors strictly for specific purposes, such as hosting, cloud services, public relations (e.g. sending client information, studies and newsletters). Legally standardized data protection contracts are agreed with all service providers that we use on our websites as processors in accordance with Art. 28 EU GDPR and the service providers are subjected to a corresponding IT security assessment in advance. Eine Übermittlung personenbezogener Daten in Staaten außerhalb des Europäischen Wirtschaftsraums (EWR) findet dabei nur unter Gewährleistung eines angemessenen Datenschutzniveaus i. S. d. Art. 44 ff. DS-GVO statt. We process personal data when you visit this website as follows:
a) Logfiles
Each time our websites are accessed, so-called log files are automatically stored based on our legitimate interest in accordance with Art. 6 para. 1f EU GDPR, which contains information about accessing our websites computers, e.g. information about the browser type, the operating system used, the Internet service provider, the IP address, date and time of access. It is necessary to store this data to make our websites available to users for the duration of the session. We also use this data to optimize our websites and to ensure the security of our IT systems. The data from the log files is deleted as soon as it is no longer required for the stated purposes.
b) Registration
It is possible to use our publicly accessible websites without providing personal data. However, if you would like to personalize our website according to your interests or share relevant content and topics, for example, registration is necessary, which requires the provision of personal data. When you register for the first time, a password-protected personal account is set up. This requires you to enter your surname, first name and (business) e-mail address, among other things. We initially store the transmitted data temporarily until the account has been activated by confirming the subscription request. When registering, logging in and using the user account, the user's IP address and the time of the respective use are also recorded. We have a legitimate interest in accordance with Art. 6 para. 1 lit. f EU GDPR for security reasons (e.g. protection against misuse, unauthorized use). If you register or log in to one of our websites using a single sign-in service with a social media account (e.g. LinkedIn, Google or X), we initially only collect the data required for registration or logging in (name, email address and location). Other data and information transmitted to us depends on the data protection settings made on the respective social media platforms. Further information on data protection on the respective platforms can be found in the data protection declarations or guidelines of the respective social media services. We can also recognize you as the same user on different devices if you register or log in using a single sign-in service. This also enables us to personalize the content of other websites you visit. If information about preferences is provided during registration, we use this information to personalize the content of the website. For example, we compile the content of the dashboard based on your preferences and show you “Interesting articles for you” based on an evaluation of the articles you have recently read. It is also possible to display related articles to the articles you have read. You can unsubscribe from the personalization service at any time. All you need to do is permanently delete the account in the privacy settings. Due to our IT security settings, the deletion process can take up to two working days.
c) Newsletter, mailings, downloads
We provide a wide range of newsletters, mailings and downloads on our websites based on the user's consent in accordance with Art. 6 para. 1a EU GDPR, possibly in conjunction with Section 7 para. 2 no. 3 UWG. We may also send certain information to data subjects by email on the basis of legal permission in accordance with Section 7 (3). To register for topic-related newsletters and mailings and to download certain documents (e.g. studies) from us, you must provide your name and e-mail address. By registering or downloading, you also give us your consent to record future visits to our websites on a personal basis to provide you with targeted and personalized information on specific topics (e.g. current studies, surveys) tailored to your interests. We use a cookie from our service provider HubSpot to record the individual websites and topics that a registered user views during their visits (see also section 3f (8) below). After registering for newsletters, mailings or downloads on our websites, each user receives a e-mail-confirmation to the e-mail address provided (so-called double opt-in procedure). Registration is only complete once the link contained in this e-mail has been clicked. Once given, consent to receive newsletters, mailings or downloads can be revoked at any time via a link at the end of each e-mail or by sending a message to our e-mail address. Registrations for newsletters, mailings or downloads are logged based on our legitimate interest in being able to prove the registration and consent of a user at any time (Art. 6 para. 1 lit. f EU GDPR). If you have not used our offers in any form for one year, you are considered not interested and will be automatically deleted from HubSpot.
d) Contact form
To request further information, we provide you with contact forms at various points on our website that you can use to contact us directly. We process the personal data entered here (e.g. name, e-mail address) within the framework of the statutory provisions for processing the request in accordance with Art. 6 para. 1b or Art. 6 para. 1f EU GDPR.
f) Cookies
We use so-called cookies for the purposes listed below. A cookie is a text file that is sent from the web server to the browser and processes information about the website visitor (e.g. IP address), their settings and the devices used. In the table below, we have listed the different types of cookies that we use on our website:
Strictly necessary cookies
These cookies are essential to ensure that the user can navigate and use certain functions of the website. Without them, essential parts of the website cannot be used. Accordingly, these cookies are always activated. They are only used when you visit our website and are usually deleted after you close your browser. Cookies also make it easier to switch pages from http to https so that the security of the transmitted data is guaranteed.Functional cookies
Functional cookies enable the website to store information provided, such as the username or language selection, and to offer the user improved and personalized functions based on this. The information collected is only analyzed in aggregated form. As we want to offer you a website that is designed for optimum user-friendliness, we recommend that you activate these cookies. Functional cookies are also used, for example, to activate functions you have requested, such as the playback of videos.Performance cookies
These cookies collect data on user behavior. On this basis, the website is adapted to the general user behavior in terms of content and functionality. The information collected is generally processed further in aggregated form, unless a user has expressly consented to personalized analysis. Performance cookies are used exclusively to improve the performance of the website and to tailor the online experience to the needs of the user.Marketing cookies
Marketing cookies are used to offer content that is more relevant to the user and tailored to their interests. They are also used to measure and control the effectiveness of campaigns. For example, they register whether a website has been visited or not, as well as which content has been used. This information is used to create an interest profile so that only content of interest to you is displayed. If you withdraw your consent to marketing cookies, this does not mean that you will see and receive less content as a result. Rather, it means that the content you see and receive will not be tailored to your individual needs.Social Media Cookies
Social media cookies are used to offer content that is more relevant to the user and tailored to their interests. They are also used to measure and control the effectiveness of campaigns. For example, they register whether a website has been visited or not, as well as which content has been used. This information is used to create an interest profile so that only content of interest to you is displayed. If you withdraw your consent to social media cookies, this does not mean that you will see and receive less content as a result. We can use this data to display targeted advertising outside its website without identifying you as a website visitor. The legal basis for data processing by cookies can be either a legitimate interest of us or the consent of the user. We have a legitimate interest in the use of cookies pursuant to Art. 6 (1f) GDPR & Section 25 (2) TDDDG, in particular, in the use of strictly necessary cookies (see above). No consent is required for this. Consent is required for the use of all other types of cookies (e.g. marketing and social media cookies) (Art. 6 para. 1a, f GDPR & Section 25 para. 1 TDDDG), which can be given via the cookie banner displayed on our websites. Further detailed information on the cookies we use can be found at any time under “Cookie settings” at the bottom of each of our websites. The selected cookie configuration can also be adjusted there by the user at any time. Note: If you consent to a category, the cookies are activated immediately or when the website is reloaded. If you revoke your consent to a category, the cookies set will remain active until the end of their term. To ensure that these cookies are blocked immediately, you must delete them manually via your browser settings after revoking your consent.g) Tracking and analysis tools
We use third-party tracking and analysis tools on these websites. These use so-called performance cookies, the use of which can be adjusted via the setting options of the respective third-party providers explained below or via our cookie settings. The settings can be adjusted on each page in relation to the domain. We use the following tracking and analytics tools on these websites in detail based on a legitimate interest pursuant to Art. 6 (1) (f) GDPR
(1) Google Analytics 4
We use Google Analytics, a web analysis service of Google Inc. (“Google”) on Websites. Google Analytics uses so-called “cookies”, text files that are stored in the browser and that enable an analysis of the user's use of the website. The information generated by the cookie about the use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, the user's IP address will be shortened by Google beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use this information on behalf of the operator of this website for the purpose of evaluating the use of this website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by the browser used as part of Google Analytics is not merged with other Google data. We would also like to point out that the code “anonymizeIp” has been added to Google Analytics on this website to ensure an anonymized collection of IP addresses (so-called IP masking). As part of Google Analytics, we also use the Google Signals extension, which enables tracking across multiple end devices. For this purpose, Google uses the data of users who are simultaneously logged into a Google service during website visits and have activated the “personalized advertising” option in their Google account settings (https://adssettings.google.com/authenticated). Google Signals is also only used with IP anonymization activated. Further information on Google's terms of use and data protection can be found at http://www.google.com/analytics/terms/de.html or at https://www.google.de/intl/de/policies/.(2) Google Remarketing
This website uses Google Remarketing technology from Google Inc (“Google”). For this purpose, cookies are placed on your computer, with the help of third-party providers, including Google, record which of our websites have been visited with your browser. This information can then be used to present our advertisements to you at a later date on other websites, e.g. as part of the Google search or on websites in the Google network. Further information on data protection at Google and how remarketing works can be found in Google's privacy policy. You can also deactivate the storage of cookies here using your browser settings and/or object to the collection of data as part of Google Remarketing using the Google ad settings.(3) Adobe Analytics
These websites also use Adobe Analytics, a web analytics service provided by Adobe Systems Software Ireland Limited (“Adobe”). Adobe Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. If the information generated by the cookie about the use of the website is transmitted to an Adobe server, the settings ensure that the IP address is anonymized before geolocalization and replaced by a generic IP address before storage. On behalf of the operator of this website, Adobe will use this information to evaluate the use of the website by users, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Adobe Analytics is not merged with other Adobe data. You can prevent the storage of cookies by selecting the appropriate settings in your browser software. However, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. You can also prevent Adobe from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Adobe by downloading and installing the browser plug-in available at the following link: http://www.adobe.com/de/privacy/opt-out.html.(4) Hotjar
This website uses Hotjar. The provider is Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta. Hotjar is a technology service that helps us to better understand our users' experience (e.g. how much time they spend on which pages, which links they click on etc.) and this enables us to improve our service based on this user feedback. Hotjar uses cookies and other technologies to collect data about the behavior of our users and their devices. This includes a device's IP address (processed during your session and stored in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only) and preferred language to view our website. Further information on data protection at Hotjar can be found here: www.hotjar.com/de/datenschutz/(5) LinkedIn Insight Tag
Our website uses the “LinkedIn Insight Tag” conversion tool from LinkedIn Ireland Unlimited Company. This tool creates a cookie in your web browser that enables the collection of the following data, among others: IP address, device and browser characteristics and page events (e.g. page views). This data is encrypted, anonymized within seven days and the anonymized data is deleted within 90 days. LinkedIn does not share any personal data with us but offers anonymized reports on the website target group and display performance. In addition, LinkedIn offers the possibility of retargeting via the Insight Tag. We can use this data to display targeted advertising outside its website without identifying you as a website visitor. You can find more information on data protection at LinkedIn in LinkedIn privacy policy. LinkedIn members can control the use of their personal data for advertising purposes in their account settings. To deactivate the Insight tag on our website (“opt-out”), click here.(6) Use of JavaScript and tracking pixels (web beacons)
We use JavaScript and tracking pixels to analyze website visits. JavaScript is integrated into all our websites. JavaScript collects various information about the visitor's computer (e.g. IP address, the time the page was accessed, the browser type and the existence of cookies previously set by the same server). This data is transmitted to us via tracking pixels. You have the option of deactivating JavaScript calls in your browser. You can also deactivate tracking pixels by rejecting or deactivating the cookies associated with them.(7) Use of the conversion pixel from Adform
We use JavaScript and tracking pixel to analyze website visits. JavaScript is integrated into all our websites. JavaScript collects various information about the visitor's computer (e.g. IP address, the time the page was accessed, the browser type and the existence of cookies that were previously set by the same server). This data is transmitted to us via tracking pixels. You have the option of deactivating JavaScript calls in your browser. You can also deactivate tracking pixels by rejecting or deactivating the cookies associated with them. Further information on Adform's data protection provisions can be found at https://site.adform.com/privacy-center/overview/.(8) Location service
Our website can determine the geographical location of your device. The sole purpose of collecting this information is to provide you with information that may be of interest to you based on your geographical location. The use of the applications for smartphones and tablet computers (so-called apps) provided by us is evaluated using transmitted device identification features (device ID). The evaluation is anonymous; KPMG is not able to identify the device user.(9) Use of HubSpot
We use HubSpot, a service of HubSpot Inc., on our websites for analysis purposes. This uses so-called “web beacons” and also sets “cookies”, which are stored on your computer and enable us to analyze your use of the website. HubSpot evaluates the information collected (e.g. IP address, geographical location, type of browser, duration of visit and pages accessed) on our behalf in order to generate reports on the visit and the pages visited by us. If, as described in section 3c, our email news is subscribed to and studies and other documents are obtained, we can also use HubSpot to link a user's visits to our websites with personal details (in particular name/email address) on the basis of consent given, thus recording them on a personal basis and informing users individually and in a targeted manner about preferred topics. If HubSpot generally does not wish to collect cookies, the storage of cookies can be prevented at any time by appropriate browser settings (see section 3e above). For more information about how HubSpot works, please refer to HubSpot Inc.'s Privacy Policy, available at: http://legal.hubspot.com/de/privacy-policy.4. How long is data stored?
Unless expressly stated otherwise, we will retain personal data for as long as necessary to carry out the purposes listed above. This is subject to statutory retention obligations. The duration of the storage of personal data is regularly reviewed and, if necessary, deleted.
5. What data protection rights are data subjects entitled to?
In accordance with Art. 15 EU GDPR, data subjects have the right to information about the processing of their personal data by us (including the purpose of the processing, any recipients and the expected duration of storage), rights to rectification of incorrect data (Art. 16 EU GDPR), erasure (Art. 17 EU GDPR), restriction of processing and data portability of the data submitted (Art. 18, 20 EU GDPR) as well as the right to object to use for marketing purposes and on the basis of processing on the basis of a legitimate interest of ours (Art. 21 EU GDPR). Once consent has been given, it can generally be revoked at any time with effect for the future. To safeguard these rights, every data subject can contact our data protection officer (see section 2). In addition, there is also a right of appeal to a data protection supervisory authority. Data subjects can contact the authority of their place of residence, but in principle they can also contact any other data protection supervisory authority.
